When Is a Dispute Ready for Mediation?

Before entering into mediation, consider whether the following conditions are met:

  • The people on both sides have the authority to settle the case.
  • Both sides are ready to negotiate in good faith.
  • You are ready to talk about the events that led to the dispute.
  • You have thought about your needs and interests.
  • You have a list of possible solutions to present to the other side.
  • You have a list of questions for the other side that will help you collect the information you need to make decisions.
  • You have researched the law relating to your dispute, so you have at least some idea about your alternatives if you do not resolve the matter in mediation.
  • You understand the process of mediation and know what to expect.
